For an application to be effective, it must permit the applicants the freedom to make choices or, as the Percy Commission said, '[the applicants] must be free to accept or reject medical advice and decide whether or not to make the application for admission to hospital' (HMSO, 1957, para. 404). The obvious people to provide that corrective are the patient's relatives who, on the basis of protective kinship, are expected to act on the patient's behalf and make decisions when the patient is unable to make them for himself.

A social worker should also be able to make the recommendation when there is no known relatives available . . and (where necessary) to make the application against the wishes of the relative' (para. 403). The 1983 Act, Section 11(1) says '. . an application for admission for assessment, an application for admission for treatment and a guardianship application may be made either by the nearest relative of the patient or by an approved social worker; and every such application shall specify the qualification of the applicant to make the application'.

That would not be in his or in the hospital's interest. Similarly, psychiatrists do not go around searching for patients, trying to pursuade others to make the application. The psychiatrist has patients referred to him normally from GPs but, just as often, from social Social workers and applications 31 workers and relatives. To refer is to ask for advice which may, by implication, suggest that the patient needs medical/psychiatric treatment.
